NALCOR AND CONSULTANTS FACE LIABILITY IF NORTH SPUR FAILS

Guest Post by Cabot Martin
My last post on the Uncle Gnarley Blog - entitled Premier Needs Quebec Judge's Help On Forensic Audit - was about possible criminal activity on the Muskrat project and the need for a forensic audit.
The previous piece I authored - back in May - was called Of Deceit, Emera and Muskrat Madness. It described a possible action of civil deceit against Emera with respect to their very burdensome Muskrat contracts with Nalcor.
Both very important issues.
But as my good friend Con O’Brien is quick to point out, over-riding all is the North Spur.
Muskrat must be halted for that reason alone – Now.
But that issue sometimes (all the time?) gets lost in the Muskrat shuffle.
So let’s go through it yet one more time.

DOUBLE TROUBLE IF NORTH SPUR COLLAPSES

Guest Post Written by Cabot Martin

Minister's August 26, 2015 Letter Confirms James L. Gordon's Concerns

The attempt to bring some clarity to the North Spur landslide issue seems to be making headway – if in a very disturbing way.

Attached is a letter from Minister Dan Crummell (Minister responsible for Dam Safety) dated August 26, 2015 in answer to my letter to him of August 7,2015 together with my reply of September 11, 2015 to the Minister's latest letter. (Both letters are shown below.)

While this letter exchange with the Minister involves some pretty technical matters, this should not deflect us from the conclusion that an independent, engineering-based and technically competent review is needed. My latest letter closes with a call for a “Hydro Review Board” that would do just that.

THE ‘ROCK’ STAR OF “QUICK CLAY”

The biography of Dr. Stig Bernander reads like that of a ‘Rock’ Star except in his case, he is better known for his work with clays rather than rocks, especially “Quick Clay”.  Some of this “sensitive” material is present at the North Spur, the projection of land creating the natural dam at Muskrat Falls.  It is one of the issues which threaten the viability of the project.

Dr. Bernander, you ask?  Who is he and why would you be interested? I will get to those questions in a moment. First, what are “Quick Clays”?

Quick Clays are unique, sensitive glaciomarine clays.  The clay deposits occurred when sea water levels were much higher.  They are unstable clays. Their peculiar characteristics are known to cause landslides.  When Quick Clay is subjected to sufficient stress, the material may liquefy. At Muskrat Falls, Quick Clay could undermine the structural integrity of the North Spur. Remediation is potentially a money pit.  It is a public safety issue, too.

One of the best known and large Quick Clay landslides occurred at Rissa, Norway.  The slide was videoed as it progressed. The event is as exciting as it is horrifying. If you choose to follow the Link, just be patient for the first couple of minutes and the Rissa video will demonstrate why Quick Clay should be taken very seriously. It is the perfect primer in advance of Dr. Bernander’s Lecture.

Bernander is neither politician nor bureaucrat. He is a scientist; one with long industry experience.

WOULD YOU BUILD YOUR HOUSE ON A RIVER OF MUD?

Cabot Martin, the well-known lawyer who served as a Senior Advisor to Premiers Moores, Peckford and Wells, recently released, a 91 page Power Point Presentation entitled: The North Spur Quick Clay Instability & Landslide Problem: The Weak Link in Nalcor's Muskrat Falls Project .

Already, you are thinking: do I have to read the entire Report?  Can I get the essence of what Martin is describing, without hiring a sitter for the day?  I will tell you how.

But, first, a couple of comments are in order.
