$900,000 TO STURGE: NALCOR BOARD AN ECHO OF THE LAST ONE
It isn’t hard to tell that it is public money about which the Nalcor Board of Directors is so cavalier, not their own.
The previous Board gave former Nalcor CEO Ed Martin $1.38 million severance even after having resigned for “personal” reasons, “to spend more time with his family.” Fired “without cause” soon replaced the well-worn excuse of the empathetic family man booted out the corporate door. The Board, caring not a whit about Mr. Martin’s behaviour — or record — as CEO, used the contortions of legal camouflage to justify the decision; even Premier Ball allowed that Martin was awarded severance in accordance with Nalcor’s contractual obligations, until this Blog caught him out in the lie.

WHO TAKES ED MARTIN SERIOUSLY, ANYWAY?
When journalists interview Ed Martin, as CBC’s Terry Roberts
did a few days ago, it is right to wonder if they go away laughing.
Unfortunately, the reporter’s interview with Martin is found only on the CBC website, so images of him uproariously slapping his sides can only be imagined.
Terry Robert’s story is about Ed Martin dissing Astaldi. Martin thinks that the Company is “largely to blame for the massive cost and schedule overruns” experienced on the Muskrat Falls project.

ED MARTIN'S HYDRO PURGE OF 2005

In
my guest post of October 4th I explained how the 2002 Gull Island deal was scuttled by then Leader of the Opposition, Danny Williams, aided and abetted by
the then Chair of the Board of
Newfoundland Hydro, Dean MacDonald, and board member Mark Dobbin.
When
Mr. Williams became Premier in 2003 he proceeded to commence a series of
personnel changes at Newfoundland Hydro which has led directly to the Muskrat
Falls boondoggle.
The
first was the appointment of Gilbert Bennett in 2003 to oversee the Lower
Churchill project. Mr. Bennett formerly worked with Rogers Cable, whose work
experience is in telecommunications. He is no doubt a bright and competent
telecommunications engineer but it is hard to see how that experience readied
him for his current role.

SOME NOTES ON HOW THE MUSKRAT SCHEME IS FALLING APART

It will be
painful – a prospect emphasised by the recent release of the SNC-Lavalin May
17, 2013 Risk Assessment Report following on the revelations of the “Anonymous
Engineer” on pre-sanction “book cooking”
as first revealed on Uncle Gnarley.
Stand by for
more and escalating leaks.
But the
surest sign of the coming storm is the return to public airways of one Ed
Martin, former Nalcor CEO.
Like a character
in poorly made sequel of a powerful horror movie, Mr. Martin continued on CBC
TV to spout the same sort of World Class nonsense that has helped put us in our

MUSKRAT FALLS: A FAILED PROJECT BEFORE IT STARTED (and nothing has changed)

I recently
had a look online simply using the search criterion, "Muskrat Falls".
A NL Govt. website featuring the 'Muskrat Falls Oversight Committee' showed up
so I decided to have a look at what this "Oversight Committee" does.
I didn't have to look hard to realize that the word 'Oversight' in the name was
at best a misnomer.
Amongst
other things, the web page states the following: "Chaired by the Clerk of the Executive Council, the committee comprises
senior officials from Executive Council and the Departments of Finance, Natural
Resources and Justice. It is supported by a working group representing
expertise in the areas of law, engineering, project management, accounting and
auditing."
This sounds
like a good beginning for such a Govt. Oversight Committee; the right types of
people for undertaking vital governance practices for a mega-project are
identified. Apparently, however, the good beginning didn’t get any further than
this.

PREMIER NOT TELLING TRUTH ABOUT SEVERANCE DEAL WITH ED MARTIN

- Ed Martin’s employment contract offers no
legal basis for either severance or bonus
- Premier Ball has obscured the reason for Ed
Martin’s departure and failed in his
obligation to tell the public the truth.
Introduction
The assertion by Premier
Ball that he was contractually obligated to pay severance to former CEO Ed
Martin who resigned from Nalcor on April 20th, 2016 is neither based
in law, nor in fact, at least not as it applies to his employment contract.
The Premier stressed, according to CBC, that Martin's resignation was a
"personal one". Ball said it “was first discussed at a meeting
between the two on Sunday, and later confirmed on Tuesday evening". The
timeline is just one important detail.
